1. What is a Long Term Care Consultation?

An in home assessment available through county and tribal agencies to help consumers decide how much service and what kind of services are needed as well as what services are available in your community. This visit is free and available to people at all income levels. Long Term Care consultants can help you:
• Stay in your own home or apartment
• Move from a long term care facility
• Move to foster care or housing with services settings
• Understand your choices in services
• Develop a plan and choose services to meet your needs
• Access programs that help pay for services if you are eligible

2. Who pays for long term care services?

You may pay for some of your services. If you qualify, there are additional funds available through Minnesota Health Care Programs. Medical Assistance, for example may help pay for your nursing home care at a qualified facility.

3. Who pays for services in home or community living settings?

Medical Assistance or the Alternative Care Program may help pay for the care you receive in your home or in other community living settings if you meet what are called “level of care requirements” in addition to financial eligibility requirements. Level of care requirements mean that you must have certain kinds of needs, and need certain kinds of services before Medical Assistance or state-funded programs will pay for your long-term care services.
For people who meet the above requirements, home and community based services are available under several programs such as Alternative Care, Elderly Waiver, and Consumer Alternatives for Disabled Individuals and Brain Injured.

4. What is a Rule 25?

It is a Chemical Use Assessment. A person might need an assessment because of a court order, involvement with child protection, his or her employer is requiring one, or because he or she is seeking treatment for chemical dependency. A Rule 25 is a face-to-face interview with a certified Rule 25 Assessor. It takes about an hour and a half to two hours to complete. 5. Can you find housing for people who are homeless? With CD issues? With Mental Illness?

This varies from situation to situation. If you are homeless, it is recommended that you talk with a Mental Health Intake Worker or Chemical Dependency Intake Worker. We are not able to house people who do not have a mental health diagnosis or chemical dependency concerns.

6. Do you need to make an appointment to see a Mental Health Intake Worker?

Not always, but if you make an appointment they will be readily available. You can call 218-824-1140 and ask for Mental Health Intake in order to make an appointment.

7. Why would someone need to be committed?

Because they are a danger to themselves or others due to their mental illness or chemical dependency. Minnesota Statute has clearly defined criteria regarding what constitutes a danger to self or others. The National Alliance on Mental Health has a publication regarding the commitment process which you can view here.

8. What is Rule 79?

Mental Health Case Management for someone with a serious and persistent mental illness. The Department of Human Services website has more information about Rule 79

9. Why do some people receive Rule 79 services and some do not?

You need to meet specific criteria to receive Rule 79 services so not everyone who requests Mental Health Case Management services will receive Rule 79 services. The Department of Human Services website has more information about Rule 79

10. What is Medicare?

Medicare is a federal system of health insurance for people over 65 years of age and for certain younger people with disabilities.
The different parts of Medicare help cover specific services:
Medicare Part A (Hospital Insurance)

• Helps cover inpatient care in hospitals, skilled nursing facilities, hospice, and home health care.
• Most people don’t have to pay a premium for Medicare Part A because they or a spouse paid Medicare taxes while working in the United States. If you don’t automatically get premium-free Part A, you may still be able to enroll, and pay a premium.

Medicare Part B (Medical Insurance)

• Helps cover doctors’ and other health care providers’ services, outpatient care, durable medical equipment, and home health care.
• Helps cover some preventive services.
• Most people pay up to the standard monthly Medicare Part B premium. Note: You may want to get coverage that fills gaps in Original Medicare coverage. You can choose to buy a Medicare Supplement Insurance (Medigap) policy from a private company.

Medicare Part C (also known as Medicare Advantage)

• Offers health plan options run by Medicare-approved private insurance companies.

Medicare Advantage Plans are a way to get the benefits and services covered under Part A and Part B. Most Medicare Advantage Plans cover Medicare prescription drug coverage (Part D).
Some Medicare Advantage Plans may include extra benefits for an extra cost.

• Helps cover the cost of prescription drugs
• May help lower your prescription drug costs and help protect against higher costs
• Run by Medicare-approved private insurance companies

11. What is Managed Care for seniors?

The Minnesota Department of Human Services contracts with Managed Care Organizations (MCO) to deliver health insurance to people on Medical Assistance and Medicare over the age of 65. In Crow Wing County the managed care organizations in contract are: Blue Plus Blue Shield, UCare and Medica. The MCO is the primary health insurance with a Crow Wing County care coordinator.

12. What is MSHO for seniors?

The Minnesota Senior Health Options (MSHO) is a health care program that combines separate health programs and support systems into one health care package. It is for people ages 65 and older who are eligible for Medical Assistance (MA) and enrolled in Medicare Parts A and B. Through a Managed Care Organization, MSHO enrollees are assigned a Crow Wing County care coordinator who will help them get their health care and related support services.

13. What is MSC plus for seniors?

Minnesota Senior Care Plus (MSC Plus) is a health care program for seniors 65 and older who qualify for Medical Assistance (Medicaid). Managed care enrollees who do not choose to enroll in MSHO will be enrolled in MSC or MSC Plus. Minnesota Senior Care enrollees will receive their MA state plan services through their managed care organization (MCO), and are assigned a Crow Wing County care coordinator who will help them get their health care and related support services.

1. Who can apply for child support services?

Child support services are available to anyone who has a child not living with both parents.

2. What if I would like to authorize another person to contact the child support office and obtain information on my case?

3. How can I stop child support services?

If you were the applicant for services, you can complete a request to stop services form from the Minnesota Child Support Division website and submit it to your local child support office. If there are no public assistance programs open and no public assistance past due support owing on the case, the child support office will remove charges and balances owed to you and will process the case for closing. 4. My child is 18 years old and will graduate high school in June. My child is planning on attending college in the fall. Will my child support continue while they are in college?

Secondary school is defined as high school; not college. Child support charges end when a child turns 18 or graduates high school, whichever is later, up to age 20. Also, charging can continue if the child who, by reason of physical or mental condition, is incapable of self-support.

5. I misplaced a copy of my court order. How do I get another copy?

Contact the Court Administrator's office in the county that issued the order.

6. Several months ago my child turned 18 and stopped attending high school. My child support stopped, but now my child is back in school. How can I get child support payments started again?

After child support charges were stopped due to a child being considered emancipated, the parent request support payments will need to file a motion to modify your order with the Court to ask the judge to order the support payments to begin again. 7. I am the spouse of someone who owes past due child support and the child support office intercepted our joint tax refund. Most of it was mine and I want my portion back. How do I get it?

If it was a federal tax refund an injured spouse form 1099X should have been filed with the IRS when you prepared your taxes. If this was not filed you will need to do this for the IRS to send you your portion of the refund.

8. I went to court and just received my order and think it is wrong. What can I do?

You can file a motion to correct clerical error or a motion to review judge's decision within the time frames specified in your order. The forms and procedures can be found at: www.mncourts.gov/forms

9. What should I do if I think someone is committing fraud?

10. I think I may be the father of a child that has not been born yet and I'm concerned the mother wants to give it up for adoption without my consent, what can I do?

11. What do I do if I have safety concerns with the other parent?

You can report safety concerns to your child support worker and they will make a record of your concerns and depending on the circumstances you may be referred to other departments in the agency.

12. I lost my pin number to access my case online and through the payment line. How do I get a new number?

You can contact the child support office servicing your case and they can mail you a new pin number.

13. What if the other parent won't let me see the child or we don't agree on a schedule?

Child support and parenting time are separate legal issues. This office cannot provide you with advice or assistance regarding custody or parenting time. You may wish to consult a private attorney for these issues.

14. My driver's license has been suspended for non-payment of child support. I need a driver's license to work. How do I get the suspension lifted?

Contact you Child Support Officer about entering into a possible payment agreement. As long as you remain current with payment agreement lifting of the suspension will continue. For more detailed info click here www.dhs.state.mn.us

15. How do I get my passport hold released?

Contact the Minnesota Child Support Enforcement Division at 651-431-4400 to find out what must be done to release the hold.

16. How do I change my child support order that is managed through the county?

If your child support case is managed through a child support office, you can submit a signed and dated request for a review of your order to their office. You will receive notification if the child support office will do the review for you of if your request has been denied.
If your request is denied, you may proceed by filing your own motion in the Expedited Process. The court forms and procedures are published through the court
website.

17. How do I change my child support order if my case is not through the county?

If you do not have an open child support case through a county office, you can use the court forms and procedures that are published to file the motion yourself in District Court. The forms can be found at the courts website.

1. How do I become an adoptive or foster home?

2. How do I report child abuse or neglect?

Child abuse/neglect reports can be made Monday through Friday from 8:00 AM to 5:00 PM by calling Crow Wing County Social Services at (218) 824-1140 and asking for Child Protection Intake. After hours reports can be made by calling the Crow Wing County Sheriff's Department at (218) 829-4749. Reports can be made anonymously with the exception of a Mandated Reporter (Individual's working directly with children i.e. teachers, daycare providers, doctors, etc.)

3. How do I become a licensed child care provider?

1. Can I apply for cash, food and medical assistance online?

Yes. ApplyMN is Minnesota’s secure, online system you can use to apply for cash assistance, SNAP (food support), emergency help, and child care assistance programs. To apply for health care coverage, inquire at mnsure.org.

2. What programs require a face-to-face interview?

Emergency Assistance and certain Cash Assistance programs (MFIP and DWP, both family cash programs) typically require a face-to-face interview. Those interviews are offered Monday through Friday from 9 a.m. to 2:30 p.m. Interviews for food and other cash programs can be conducted as a scheduled interview over the telephone.

3. Who qualifies for help with the cost of a funeral?

Any Crow Wing County resident that does not have enough funding to cover the cost of a basic funeral and burial and meets the required asset limitations may qualify for help with the cost of a funeral. There is a maximum the county can pay. A family member or friend can apply for this program. Please contact the county office for more information and to receive an application.

4. How do I apply for health care coverage?

Inquire via mnsure.org. If you need assistance in applying for health care, you may contact a MNsure navigator to set up an appointment or you can contact your county office for more information. For contact information and available dates for a navigator or if you are 65 or over, certified disabled through Social Security Administration, or are receiving Medicare, please contact your county office for the appropriate application.

5. What is SNAP (Supplemental Nutrition Assistance Program)?

SNAP can help you get the food you need for sound nutrition and well-balanced meals. The program issues electronic benefits that can help stretch your food budget. SNAP is not intended to meet all of your food budget needs.

6. What is DWP (Diversionary Work Program)?

DWP is a four-month program that provides services and supports to eligible families to help them move immediately to work rather than go on public assistance. The four months of DWP do not count towards the 60-month lifetime limit for the MFIP program, the state's Temporary Assistance for Needy Families (TANF) program.

7. What is GA (General Assistance)?

GA helps Minnesotans with little or no income meet their basic needs. It offers a small monthly cash grant to people with serious illnesses, disabilities, or other issues that limit their ability to work. GA is "interim aid" to help while other sources of income are put in place.

8. What is MFIP (Minnesota Family Investment Program)?

MFIP is Minnesota's program that assists low-income families with children to economic stability through work. The MFIP grant includes a cash grant, food assistance, and employment services. Parents must meet work rules immediately or their MFIP grant will be reduced.

9. What is MSA (Minnesota Supplemental Aid)?

MSA provides monthly cash support to help meet basic living expenses, such as clothing, utilities, housing, or special medical diets. It is mainly for people who receive Supplemental Security Income (SSI).

10. Who qualifies for Emergency Assistance?

Emergency help gives aid to a family with a defined emergency such as an eviction, utility disconnect, foreclosure, or loss from a fire. If you quality, this funding can be provided once in a 12-month period. For more information on emergency assistance, please call our office at (218) 824-1250 or stop in our office Monday-Friday from 9 a.m. to 2:30 p.m. to see if you qualify.

11. How do I apply for Energy (fuel) Assistance?

Lutheran Social Services of Brainerd maintains the Energy Assistance program for Crow Wing County. Please contact them toll free at 800-828-5902 or at (218) 829-5000.

12. What is GRH (Group Residential Housing)?

GRH is a state-funded program that pays for room and board costs for low-income elderly and adults with disabilities living in some licensed or registered community-based settings. The program aims to reduce and prevent institutional residence or homelessness.

13. What is EW (Elderly Waiver)?

The EW program funds home and community-based services for people age 65 and older who are eligible for MA and require the level of care provided in a nursing home but choose to lve in the community.

14. What is AC (Alternative Care)?

The (AC) Alternative Care Program is a state-funded program that supports certain home and community-based services for older Minnesotans, age 65 and over, who are at risk of nursing home placement and have low levels of income and assets. The program is administered by counties.

15. What is an Asset Assessment?

An Asset Assessment is a list of all assets owned by a married couple on a certain date. A county worker uses the information to decide the amount of assets a person's spouse can keep. The amount of assets will not county toward the asset limit for the person applying for Medical Assistance payment of long-term care (LTC) services. LTC services include nursing home care and services through the Elderly Waiver (EW) or Alternative Care (AC) program.

16. How long does it take until I know that I am approved or not?

The state typically allows the counties up to 30 days for cash or food programs and up to 45 days for health care programs. Those processing times are dependent on eligibility and the time it takes for the client to submit the necessary verifications.

17. Is there any help with medical bills if I am disable AND working?

Medical Assistance for Employed Persons with Disabilities (MA-EPD) allows working people with disabilities to qualify for MA using higher income and asset limits. To qualify, you must be certified disabled by Social Security Administration or the State Medical Review Team (SMRT); be employed and have the required taxes withheld or paid from earned income; have monthly earnings of more than $65 (there is no upper limit); meet the MA-EPD asset limit; pay a premium, if required; and pay an unearned income obligation, if required.

18. Can I provide verifications online with my application?

Yes. ApplyMN links to a list of verifications required for each ApplyMN program. Applicants are given the option to electronically attach verifications to the application before they submit it.

19. Will I need to come into the office and see a worker if I want health care assistance only?

No. There is no requirement for a face-to-face interview for any health care program. A worker will contact you if additional verifications are needed.

20. May I get a receipt to show I submitted verifications for my cash, food, or medical case?

Yes, we will provide a receipt upon your request.

1. Where do I get a swing-away mailbox support?

Mailbox supports are available at the Highway Department office. The cost is as listed in the current Fee Schedule, plus sales tax.  Residents who have their mailbox along a county road may request installation of a mailbox support on-line under Online Services, Highway Permits.  For mailboxes not on a county road, hardware is available for purchase and pick up at the office. 

2. There is a dead deer, tire, appliance, etc. in roadway or ditch. Who do I call?

Most trusts can qualify for homestead. A Certificate of Trust must be submitted and approved by the county assessor or the complete signed trust must be provided for the assessor's review.

A reduced class rate for homestead property is provided for any person who is blind or is permanently and totally disabled or a market value exclusion for qualifying disabled veterans. 4. How often do I have to apply for homestead?

Once the property is granted the homestead classification, it will not be necessary for you to reapply for the classification, unless there is a change in ownership of any kind. However, at any time, the County Assessor may require you to provide an additional application or such proof as they deem necessary to verify that you continue to meet the requirements of the homestead classification.

5. What will happen if I file a false homestead claim?

A property owner who obtains or attempts to obtain homestead classification for a property other than his or her primary place of residence or the primary place of residence of his or her qualifying relative is under state law subject to a fine of up to $3000 and /or up to one year of imprisonment (Minnesota Statute 609.41). In addition, the property owner will be required to pay all tax, which is due on the property based on the correct property class plus a penalty equal to the same amount (Minnesota Statute 273.124, Subd. 13).

6. Why is the property classified as non-homestead?

In most situation, it is because application for the homestead has not been applied for in the assessor's office.

7. Why must I provide my social security number?

Even though social security numbers are private information, they must be provided before a homestead can be granted. Social security numbers will be used with the help of the Department of Revenue to determine if owners or relatives of owners have applied for more than one homestead.

8. What if I move?

If at any time the property is sold, or you change your primary residence, state law requires that you notify the County Assessor within 30 days. If you fail to notify the Assessor within the 30 days, you may be required to pay the tax, which is due on the property based on the correct property classification plus a penalty of the same amount.

9. What is a Notice of Valuation and Classification?

The County Assessor is responsible for notifying all property owners of the estimated market value and classification of their property through an annual notice.

10. Who receives a Notice of Valuation and Classification and when is it mailed?

This notice is sent to those persons whose property is to be included on the assessment roll if the person's address is known to the assessor. This information is sent ordinary mail at least ten calendar days before the meeting of the local board of appeal and equalization scheduled to meet between April 1st and May 31st each year. In townships and cities that have elected to transfer the powers and duties of the local board of appeal and equalization to the county, it is mailed at least ten calendar days before the open book meetings with the assessor.

11. If a property owner fails to receive Notice of Valuation and Classification, what should be done?

The property owner should immediately contact the county assessor's office. There are times when this notice is lost in the mail, returned as undeliverable, or sent to another person because the ownership record and/or mailing address have not been updated by the responsible party. Whatever the cause for not receiving a notice of assessment, Minnesota Statute 273.121 states that in no way is the validity of the assessment, the resulting tax, procedures of any board of appeal and equalization, or the enforcement of delinquent taxes affected.

12. Does the Notice of Valuation and Classification address the property tax impact of the new assessment?

The probable property tax impact of the new assessment is not addressed through this notification. Tax impact information is published in November of each year on a notice of proposed property tax also known as a truth-in-taxation statement. At that time, the responsibility of elected officials in establishing the property tax levies is made clear. This latter notice provides property owners with an estimate of how much their property tax bill will either increase or decrease due to spending or other factors.

13. What is Estimated Market Value?

As referred to previously, the Assessor is responsible for valuing property at its Estimated Market value. Estimated Market value can be defined as the highest price in terms of money which a property will bring in a competitive and open market under all conditions requisite to a fair sale, the buyer and seller, each acting prudently, knowledgeably, and assuming that neither is under undue duress. According to state law, the Assessor's Estimated Market value is supposed to represent 100% of real value as expressed in the market place. The Minnesota Department of Revenue and the Minnesota Tax Court sit in judgment annually to determine whether the Assessor's Office has done its job according to statute. The performance of the Assessor's Office is measured statistically by the use of sales ratio analysis. By law, assessor's values are to be within 90% and 105% of sale price of the sales period of October 1, 2012 through September 30, 2013 for the 2014 Assessment. If this level of assessment is not achieved, the county is subject to valuation adjustments by the Department of Revenue or The Minnesota Tax Court.

14. How does the Assessor determine Estimated Market Value?

Minnesota state law requires that the value and classification of all real and personal property be established as of January 2nd each year. A mass appraisal process is used for estimating market values. Information from all sales that occur within the county is collected and closely analyzed by Property Valuation & Classification Office. The Property Valuation & Classification Office then adjusts the Estimated Market Value accordingly.

15. What is the difference between assessment year and tax year?

Your property is assessed (or valued) in one year and taxed on that value in the next. For example, property valued for the 2014 assessment will pay taxes on that value in 2015.

16. Why does my value change when nothing has been done to my property?

Supply and demand create market value and assessors measure it. In an appreciating market, as demand increases and the cost of buying property increases, other property values will rise too. The same is true, in reverse in a declining market.

17. Why doesn't the Assessor's value reflect the sale price of my property?

The number one reason is that there is a lag between the time of the assessment and when the sale takes place. The Minnesota Department of Revenue has a fact sheet "My House is Worth What?" that explains in depth why many times the assessor's estimated market value and the sale price of a property are usually different.

18. I don't want the Assessor to view my property; can he/she change the value without viewing it?

The simple answer is yes and if you don't allow access to your property you lose your right to appeal the value that has been placed on your property. Minnesota Statute 273.20 states "Assessor may enter dwellings, buildings, or structures." Any officer authorized by law to assess property for taxation may, when necessary to the proper performance of duties, enter any dwelling-house, building, or structure, and view the same and the property therein. Any officer authorized by law to assess property for ad valorem tax purposes shall have reasonable access to land and structures as necessary for the proper performance of their duties. A property owner may refuse to allow an assessor to inspect their property. This refusal by the property owner must be either verbal or expressly stated in a letter to the county assessor. If the assessor is denied access to view the property, the assessor is authorized to estimate the property's estimated market value by making assumptions believed appropriate concerning the property's finish and condition.

19. Does the Estimated Market Value increase at the same rate on all properties?

No, it does not. There are differences between individual properties and between cities or townships. In one area the sales may indicate a large increase in value and in another area there may be very little or no change in value. Also, different types of property within the same area may show different value changes. There are numerous factors to be considered in each property which will cause value changes to differ. Some of the factors that can affect value are location, condition, size, quality, basement finish, garages, and many other factors.

20. Can the Estimated Market Value change even if the assessor has not been inside my property?

Yes, the Assessor keeps records on the physical characteristics of each property in the county. Even though the assessor may have been unable to go through your property, the Estimated Market Value will be reviewed based on existing records and sales of similar property.

21. Why is the property assessment classification different than the zoning classification?

Property classification for property assessment purposes is based upon actual use or the highest and best use of the property.

22. Why has my value gone up?

People make value by their transactions in the market place. Property values are based on market values which fluctuate with general economic conditions such as interest rates, inflation rates, supply and demand and changes in tax laws. By Minnesota state law, as property values change in the marketplace, those changes will be reflected in the assessor's Estimated Market Value based on history of sales.

23. What will happen to my value if I improve my property?

Generally speaking, improvements that increase the market value of a property will increase the assessor's market value. The following are typical improvements that will increase the market value of your property: added rooms or garages; substantial updating of kitchen or bath; basement or lower level finishing; replacing old siding or windows; extensive remodeling

24. Will my value go up if I repair my property?

Good maintenance will help retain the market value of your property. Generally, your market value will not be increased for individual minor repairs such as those that follow. However, a combination of several of these items could result in an increase in your value: replacing water heater; repairing roof shingles; repairing steps or sidewalks; repair original siding; painting/decorating; replacing plumbing or electrical fixtures

25. Is my property abstract or torrens?

26. Do I have an easement for my property?

In order to determine if there is an easement of record for your property, a search would need to be done. You will need to contact an attorney or title company, or you can search our records in our public research room.

27. How do I fill out the documents for recording?

We do not provide legal advice on how to fill out or prepare documents for recording. If you have questions you will need to contact an attorney or a title company.

28. My spouse passed away and I need to remove his/her name from ownership on my property. How do I do so?

Please contact a real estate attorney or title company to assist you with obtaining the correct documents.

29. How may I find out if / when a property is going to forfeit because of past due taxes?

30. Are all tax forfeited lands, as shown in the plat book, available for sale?

No, in general, the policy over the last three decades has been to retain the acreage tracts, as shown in the plat book and manage said lands for multiple use public benefits ie: timber management, recreation, wildlife, wetland protection, and similar benefits.

31. What tax forfeited lands are available for sale?

City lots, platted property and small acreage.

32. Can I purchase parcels that did not sell at the public auction?

Yes, any parcel that did not sell at public auction may be purchased for the starting bid at the Land Services Office. These parcels are available for sale until such time as they are withdrawn from the list by county board action. Sale price is not negotiable.

33. Are tax forfeited lands with structures ever sold at auction?

Yes, on occasion. Due to the additional liability to the county, our goal is to sell properties containing structures as soon as possible.

34. Can I purchase under contract?

Yes, after paying the minimum down payment of 15% of the purchase price, the balance is paid in five (5) annual payments for sales $1,001-$20,000 or Ten (10) annual payments for sales more than $20,001. If purchase price of tract is less than $1,000, payment in full is required.

35. How do I handle Special Assessments?

If special assessments are listed on the sale brochure, the assessments must be paid in full at the time of sale. Check with City/Township clerks for any pending special assessments of which Land Services is not aware.

36. How do I receive a land sale brochure?

Call the Land Services Department to be placed on the mailing list. Or, check Crow Wing County's Web page for availability of the list of parcels. Additionally, notification will be mailed to all adjoining/adjacent landowners of a tax forfeited parcel being offered for sale.

37. What are the payment requirements after the sale?

If you have successfully purchased a tract, you must make payment and, if applicable, finalize contract arrangements in Land Services prior to 5:00 p.m. on the day of the sale. Cash, check, money order, cashiers check and Visa, MasterCard and Discover cards are all acceptable methods of payment.

38. What is the interest rate?

The state dictates the interest rate and may fluctuate from year to year. Currently the interest rate is 10%.

39. What type of deed is used to transfer title?

When the property has been paid in full, the Minnesota Department of Revenue will convey title by means of a State Deed.

40. Who determines the tracts to be offered for sale?

The Land Services Department makes the preliminary determination and develops a preliminary land sale list for County Board review. Tracts are placed on the preliminary list after considering individual requests and department recommendations.

41. Do I have to stake my project area?

The project area is required to be staked out prior to the site visit by staff to ensure all standards are met prior to the issuance of the permit.

42. How do I find land use permit fees and applications?

43. What do I need to obtain a land use permit?

All land use permit requests require a completed application, site plan, appropriate fee and a current compliance inspection or certificate of installation. In addition, properties located in the shoreland district require evidence that the septic system has been maintained within the last three years.

44. How do I get a permit to install a septic system?

Contact a Minnesota Pollution Control Agency licensed designer to determine the appropriate septic system type, size and location for your property. After the septic system design is approved by the County, submit an application to Land Services with the appropriate fee.

45. What is the Development Review Team (DRT)?

DRT is a pre-application meeting that all applicants are required to attend prior to making application to the Planning Commission/Board of Adjustment for a plat, land use map amendment, conditional use permit or variance.

1. Do I need to give my tenant notice prior to starting the Eviction Action?

It depends. If you have a written lease, read through the terms to see whether it requires a specific kind of notice. If you plan to bring an eviction case because the tenant has broken any of the terms of the lease, you generally do not have to give notice before starting the case. However, if the tenant has not broken the terms of the lease, notice is usually required. If you give the tenant a proper written notice to vacate and they do not leave by the date in your notice, you may be able to bring an eviction case based on their failure to leave.   

2. Can I evict someone living in my property if I do not know their name? For example, they are not listed on the lease.

Yes, you can list a tenant as "John Doe" or "Jane Doe" if you do not know their name.

3. I let someone stay at my home and now they won't leave. How do I get them out?

Even if your houseguest never signed a lease or paid rent, it is possible that they may still be considered a tenant under MN law. If you have established a landlord-tenant relationship with your houseguest, then you will need to go through the eviction process to remove the tenant. If you have not established a landlord-tenant relationship, there may be other non-court options you could try. Visit the MN Courts website for more information.

4. What happens if the eviction documents are not served within the time frame?
